These Terms and Conditions set out the basis on which Rubbish Clearance Richmond provides rubbish removal, waste collection and related clearance services. By requesting a quotation, making a booking, or allowing our team to commence work, you agree to be bound by these Terms and Conditions. Please read them carefully before using our services.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

1.1 Rubbish Clearance Richmond, we, us and our mean the waste collection and clearance service provider identified in your quotation or booking confirmation.

1.2 You and your mean the customer who requests and/or receives the services, whether as an individual, business, landlord, tenant or other organisation.

1.3 Services mean rubbish removal, waste collection, house or garden clearance, commercial clearance, and any additional services we agree to provide.

1.4 Booking means any request for services made by you and accepted by us, whether by telephone, email, online form or other agreed method.

1.5 Waste means any materials, items, rubbish, junk, debris, furniture, appliances or other items agreed to be removed and lawfully disposed of through our services.

2. Scope of Services

2.1 We provide waste collection and rubbish clearance services for domestic, commercial and other premises, including but not limited to household clearances, garden waste removal, bulky item collection and general rubbish removal.

2.2 The services to be provided will be described in your quotation or booking confirmation and may include estimated or fixed pricing, anticipated volumes, labour requirements and time slots.

2.3 We reserve the right to refuse to remove any items that we reasonably consider to be hazardous, prohibited, unsafe to handle, or not in accordance with applicable waste regulations.

2.4 We do not dismantle or disconnect gas, electrical or plumbing installations unless expressly agreed in advance and subject to any additional charges and safety requirements.

3. Booking Process

3.1 You may request a quotation or make a booking by telephone, email or via our online enquiry methods where available.

3.2 When requesting services, you must provide accurate and complete information about the location, access conditions, type and approximate volume of waste, parking arrangements and any special requirements.

3.3 Quotations given before our arrival are based on the information you provide and are subject to change following an on-site assessment. We will confirm or revise the price once our team has inspected the waste.

3.4 A booking is only confirmed when we have accepted your request and provided a booking confirmation by email, text or verbally, and where applicable, when any required deposit has been received.

3.5 Time and date of attendance are given in good faith but are estimates only. While we will use reasonable efforts to attend within any agreed time window, we cannot guarantee exact arrival times and accept no liability for delays caused by traffic, weather, access issues or other circumstances beyond our control.

4. Access and Parking

4.1 You are responsible for ensuring that we have safe, reasonable and lawful access to the premises and to the waste to be collected.

4.2 You must inform us in advance of any access restrictions, height limits, road closures, parking controls or loading requirements that may affect our ability to carry out the services.

4.3 Where parking charges, permits or fees apply, you agree to either arrange suitable parking in advance or reimburse us for any parking costs and penalties reasonably incurred in providing the services.

4.4 If we are unable to complete the services due to insufficient access, unsafe conditions or parking problems beyond our control, we may charge a call-out fee and any wasted time at our applicable rates.

5. Pricing and Quotations

5.1 Prices may be based on volume, weight, type of waste, labour time, access conditions and any additional services requested.

5.2 Any quotation provided prior to our arrival is an estimate only and may be revised once our team has inspected the waste on site.

5.3 If the actual volume or nature of the waste differs from the information you supplied, we reserve the right to adjust the price accordingly before commencing work.

5.4 All prices are quoted in pounds sterling and may be subject to VAT where applicable. The quotation or booking confirmation will indicate whether VAT is included or excluded.

5.5 We may revise our pricing structure from time to time. The price applicable to your booking will be the one confirmed at the time of booking, subject to any adjustments following on-site assessment.

6. Payments

6.1 Unless otherwise agreed in writing, payment is due in full upon completion of the services on the day of collection.

6.2 We accept payment by cash, bank transfer and major debit or credit cards, subject to availability of payment methods at the time of service.

6.3 For business customers, we may agree credit terms at our sole discretion. In such cases, invoices must be paid in full within the agreed period stated on the invoice.

6.4 If payment is not received on time, we reserve the right to charge interest on the overdue amount at the statutory rate and to recover any reasonable costs incurred in pursuing payment.

6.5 We may withhold or suspend further services until outstanding balances are settled.

7. Cancellations, Amendments and Failed Collections

7.1 You may cancel or amend your booking by contacting us as soon as possible and no later than 24 hours before the scheduled appointment.

7.2 If you cancel with less than 24 hours notice, we reserve the right to charge a cancellation fee to cover administrative and scheduling costs.

7.3 If our team attends your premises at the agreed time and is unable to carry out the services due to your absence, lack of access, unsafe conditions or other reasons beyond our control, we may charge a call-out fee and any wasted time.

7.4 We may cancel or postpone a booking if we are unable to perform the services safely, lawfully or due to events beyond our reasonable control, including severe weather, accidents, vehicle breakdown or staff illness. In such cases, we will seek to rebook the service at a mutually convenient time and will not be liable for any resulting loss.

8. Waste Types and Restrictions

8.1 We operate in accordance with applicable UK waste management legislation and duty of care requirements.

8.2 You must clearly identify any items that may be hazardous or require special handling, including but not limited to chemicals, solvents, paints, oils, asbestos, clinical waste, gas bottles, tyres, batteries and electrical or electronic equipment.

8.3 We reserve the right to refuse collection of any waste that we consider illegal, hazardous, contaminated, excessively heavy, or otherwise unsuitable for our standard services.

8.4 If restricted items are discovered during the collection, we may either leave them in place or agree an additional charge for their lawful handling and disposal, subject to our capabilities and licences.

8.5 You warrant that the waste supplied for collection is yours to dispose of and that you have the right and authority to arrange its removal.

9. Service Delivery and Conduct

9.1 Our team will provide the services with reasonable care and skill and will aim to complete the work efficiently and safely.

9.2 We will take reasonable steps to avoid damage to your property while carrying out the services, but you should remove or protect any items that may be vulnerable to accidental damage during clearance activities.

9.3 You agree to provide a safe working environment for our team, including clear walkways, adequate lighting and notification of any known hazards.

9.4 We reserve the right to withdraw our staff if they are subject to abusive, threatening or inappropriate behaviour, and any incomplete services in such circumstances may still be chargeable.

10. Liability

10.1 Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot legally be limited or excluded.

10.2 Subject to clause 10.1, we shall not be liable for any indirect, consequential or economic loss, including loss of profit, loss of business, loss of opportunity or loss of data arising from or in connection with the services.

10.3 Our total aggregate liability to you for any loss or damage arising out of or in connection with the services, whether in contract, tort or otherwise, shall not exceed the total amount paid or payable by you for the specific service giving rise to the claim.

10.4 We are not liable for pre-existing damage to property, for hidden defects, or for damage arising from unsafe structures or items that are unstable, excessively heavy or not reasonably suited for manual handling.

10.5 We do not accept responsibility for items that you intend to keep and that are not clearly separated or labelled from the waste to be removed. It is your responsibility to ensure that all items for removal are correctly identified.

11. Waste Transfer and Documentation

11.1 We operate under the necessary waste carrier registration required for the lawful transport of controlled waste within the UK.

11.2 Where applicable, a waste transfer note or similar documentation may be completed to record the transfer of waste from you to us or to a licensed facility.

11.3 We will dispose of collected waste only at authorised facilities such as licensed transfer stations, recycling centres or disposal sites in accordance with relevant legislation.

11.4 Once waste has been removed from your premises and loaded onto our vehicle, ownership and responsibility for that waste transfers to us, subject to any regulatory requirements.

12. Customer Responsibilities

12.1 You must provide correct contact details and ensure that someone with authority is present at the agreed time to give instructions and confirm the work to be carried out.

12.2 You are responsible for ensuring that no illegal or prohibited items are included in the waste presented for collection.

12.3 You agree to provide accurate information regarding the nature and quantity of waste, access conditions and any special considerations before we attend.

12.4 You must comply with all relevant local rules for access, parking and site safety and must not request us to perform any task that would be unsafe or unlawful.

13. Complaints and Disputes

13.1 If you are dissatisfied with any aspect of our service, you should contact us as soon as reasonably possible, providing full details of your concern.

13.2 We will investigate any complaint in good faith and seek to resolve it promptly through discussion and, where appropriate, remedial action.

13.3 If we are unable to resolve a dispute informally, either party may pursue any legal remedies available under applicable law.

14. Data Protection and Privacy

14.1 We collect and process personal information only to the extent necessary to provide our services, manage bookings, process payments and handle enquiries.

14.2 We will handle your information in accordance with applicable data protection laws and will not sell your personal data to third parties.

14.3 We may share limited information with trusted third parties, such as payment processors or disposal facilities, where this is necessary for the provision of our services or required by law.

15. Amendments to these Terms

15.1 We may update or amend these Terms and Conditions from time to time to reflect changes in the law, our services or our business practices.

15.2 Any revised terms will be published or otherwise made available and will apply to new bookings from the date they are issued. The terms applicable to your booking are those in force at the time the booking is confirmed.

16. Governing Law and Jurisdiction

16.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them or the services shall be governed by and construed in accordance with the laws of England and Wales.

16.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the services provided.

17. General Provisions

17.1 If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable, that provision shall be deemed severed from the remaining provisions, which shall continue to be valid and enforceable.

17.2 No failure or delay by us in exercising any right or remedy under these Terms and Conditions shall operate as a waiver of that or any other right or remedy.

17.3 You may not assign or transfer your rights or obligations under these Terms and Conditions without our prior written consent. We may assign or subcontract our rights and obligations where reasonably necessary to provide the services.

17.4 These Terms and Conditions, together with any quotation or booking confirmation, constitute the entire agreement between you and us in relation to the services and supersede any prior discussions or representations.
